In this instance the police acted accordingly and contrary to your beliefs they did not use their tasers in excess. In fact, they were permitted in this case to use DEADLY PHYSICAL FORCE to apprehend or terminate the crime in progress. Let me explain…. I am not privy to the SCPD&#039;s policy on the use of DEADLY PHYSICAL FORCE, but I can assure you that they were permitted to use deadly physical force in accordance with the NYS Criminal Procedure Law Article 35. You can look it up but a brief synopsis of it states that you are permitted to use such force when a burglary in the 1st degree is being attempted or committed. Now you are probably saying to yourself that he wasn&#039;t stealing anything but according to NYS Penal Law Section  140.30: A person is guilty of burglary in the first degree when he knowingly enters or remains UNLAWFULLY in a DWELLING with intent to commit a CRIME herein, and when, in effecting entry or while in the dwelling or in immediate flight there from, he or another participant in the crime causes PHYSICAL INJURY to any person who is not a participant in the crime. Mr. Bain entered his mother&#039;s house unlawfully with intent to commit a crime, which you can pick any of the following  1.) 2 counts of Criminal Contempt (felony-CRIME) 2.) Assault (misd-CRIME): assault of mother and police officers  3.) Resisiting Arrest (misd- CRIME) 4.) Obstruction of Government Administration (misd-CRIME): for not allowing police into house. Now that you know that they could have drawn their guns and potentially shot Mr. Bain, you can clearly see that they opted for a less lethal means to apprehend him. In this case they DID NOT EXCESSIVELY use their tasers. I do agree that every situation dictates whether to use a taser and the ones you brought up are a bit extreme. So far that is two things we agree on. In this case you are gravely wrong and apparently the NYS Justice System agrees. After that long winded explanation that has my fingers tired and me wondering what better things I can do with my time, I want to just address your previous post. I do not believe Mr. Bain deserved to die in this case but my opinions were based on factual information as I know them. The death of Mr. Bain should not be blamed on the police but rather Mr. Bain himself. The ends do not justify the means. He put himself in this position and the police have a job to do and they did it. The taking of a life is not easy, but in this case the intent was not to and I suspect the cause of death was a result of excessive substances in  Mr. Bain’s body. That opinion is pure speculation and will only be confirmed with a toxicology report when the autopsy is completed. Johnny, I can undoubtedly say that your opinion on this matter is strongly influenced by the mere hatred for the police. Now I don&#039;t know your background, maybe you got a few speeding tickets or maybe you are a criminal yourself, but with the facts as we know them the police hardly murdered this individual. The deceased/criminal  1.) held his 78 year old mother hostage with intent to cause physical harm to her  2.) was in criminal content for violating not just one but two order of protections 3.) physically attempted to refuse entry to the residence to brother (legal resident) and police officers 4.) assaulting police officers with the intent to resist arrest...5.) and finally if that wasn&#039;t enough for you, just add in that he was in an altered emotion state due to excessive suspected alcohol and cocaine use. If Mr. Bain stayed home and did not enter such residence as instructed to do so by the court he could have avoided such encounter with the police. We reap our own destinies. Now... with all that said the police used the least lethal method to apprehend this criminal who stands over 6’3’’ and weighs over 220 lbs. With all supporting facts the police used the proper escalation of force in this case and will be exonerated of any wrongful doing. The history of taser deaths are rare and only caused by excessive substance abuse at the time of  the tasering and also preexisting medical conditions. The easiest way not to get tasered is to not put yourself in position where you might and Mr. Bain failed to do so. In conclusion the police protected the innocent and they were all able to go home to their families that night. I appreciate the job the police are doing day in and day out and thank you all for a job well done. I leave you with this Johnny, the next time you are in a situation where your life or family members&#039; life is threatened; I only pray that the police perform their duties as they did in this situation so you can go home to your family.</description>
