A Marine from Garden City who was accused of drunken driving in an East Meadow crash that killed two brothers in August was indicted by a Nassau County grand jury on four additional charges, Nassau prosecutors announced Monday.
James Farr, 33, was arrested during the early morning hours on Aug. 23 following a crash that claimed the lives of Thomas Occhiogrosso, 27, of Riverhead, who was crossing Hempstead Turnpike near Conti Square Boulevard with his brother, 28-year-old Joseph Occhiogrosso of East Meadow, when they were both struck by Farr’s westbound BMW, Nassau police said.

Investigators said Farr had a blood alcohol content of .21 percent, more than twice the legal limit of .08 percent.
On Monday, Farr was indicted on two additional charges of second-degree manslaughter and two counts of criminally negligent homicide. The added charges do not change the maximum 15-year sentence Farr could receive if found guilty of the charges he was already facing, prosecutors said.
Farr pleaded not guilty to the new counts, as he had previously pleaded not guilty to the original charges of two counts of second-degree vehicular manslaughter and one count of driving while intoxicated. He is out on bail and due back at Nassau County Court in Mineola on Jan. 13.
“This was an unavoidable accident on James’ part,” said Farr’s attorney, Gregory Grizopoulos, who described Hempstead Turnpike as “not the safest of roadways to cross.” He added that test show the two victims were intoxicated.
Farr was assigned to the 1st Marine Corps District in Garden City and Thomas Occhiogrosso was in the U.S. Navy.
