1998 Law Used in Charging 2 in Hicksville Daycare Death


Prosecutors are relying on a rarely used law to pursue a criminal charge against two Hicksville daycare workers after a 2-year-old died from choking on a carrot.

Nassau County prosecutors say Carousel Day School owner Eugene Formica and assistant director Kathryn Cordaro pleaded not guilty after being arrested on several charges, including felony reckless assault of a child by a daycare provider.

Prosecutors unsealed an indictment against them on Wednesday.

They say they’re pursuing the felony charge using “Jeremy and Julia’s Law,” which was enacted by the state Legislature in 1998 following the deaths of infants at Albany and Florida daycares.

The two are accused in the March 17, 2009 death of 2-year-old Olivia Raspanti at Carousel.

    this is for “dedicated parent” you have some nerve saying what you did you probably never even met the mother while you were at carousel because if you did you would know she would do anything for anyone at ant time. you dont even know the true story of what happened all you here is what carousel tell every one and what the news say and they all lie and twist things around. so your a dedicated parent to who people that take your money (lol) be a dedicated parent to you child and dont worrie about things that dont concern you. didnt your mother ever teach you if you dont have anything nice to say dont say anything at all . i guess she didnt cuz maybe she wasnt a dedicated parent .

    This message is for Dedicated Parent. You are only talking this way because this did not happen to your child. Did you know the daycare was unlicensed and unprepared for a tragedy of such kind? Obviously not, because “dedicated parents” wouldn’t place their children in such a school. The owners of this daycare fooled the parents of this little girl, the parents of the rest of the class and fooled you too. The owners are in a situation to defend themselves and run a business, so they will lie to avoid any criminal prosecution and to protect their image. The parents are doing the right thing by suing the school. when is this “fake business” going to end? When something terrible happens to another child? If the little girl did take the carrot out of the teachers bag, where were the so called “teachers” to watch her? Or was it your “perfect of an angel” child right behind her egging her on?

    These people do not deserve this.
    The owner and manager are great people who would do anything for the children and their families.
    This was a horrible accident.
    Don’t forget this child’s mother worked there, is she that stupid to sue the ones who are teaching her child and who gave her a job. Maybe it’s the parents fault for not teaching their child not to go in someone else bag and take what’s not hers.
    I would never be friends with the Raspanti family for they are back stabbers.
    I would on the other hand trust Carousel. My child has attended their school and camp for 5 years and we will continue to trust them.

    Also don’t forget the mother worked there. Is she that stupid to sue the ones who watched her child and gave her a job. I would never want to be friends with the Raspanti family for they will stab you in the back.
    Carousel on the other hand I have trust for 5 yrs with my child and I will continue to.
