Police upgrade charges in fatal Merrick crossing guard crash

Upgraded charges are now being filed against the driver who struck crossing guard John Miro on Feb. 26. The development follows Miro’s death on Friday, March 6 from the injuries he sustained, according to police.

Joshua Alvarado, the driver previously charged with driving while impaired by drugs after hitting Miro with his car, is now being charged with one count of second-degree manslaughter and one count of second-degree assault, Nassau County Police said in a statement on Friday.

Alvarado had previously entered a not guilty plea to multiple charges, including second-degree vehicular assault, second-degree assault, driving while ability impaired by drugs, and operating a motor vehicle while impaired by drugs. 

Alvarado’s next court appearance is scheduled for Monday, according to court documents.
